Whilst, most
people can relate to the
frustration this shop keeper is
going through, questions have to
be asked:
Is it
acceptable to post CCTV images on
shop windows? Is it acceptable to
have in frame images of other
shoppers, even if their face is
slightly blurred?
Is it
acceptable to try someone for a
crime in a shop window rather than
a court? Do such actions prejudice
criminal proceedings?
Do such
actions breach the rights of the
individual or others in frame, in
terms of human rights, due process
and data protection?
One must
assume that the shop has cast iron
evidence to prove their
allegations against these
individuals, or they would be
risking the possibility of law
suits for defamation, libel or
even breach of data protection
legislation.
The Justice
Minister is to introduce
legislation which will see
shoplifters given fixed penalties
and if paid early will allow them
to by-pass a record.
